MODIFICATION OF ORDER: This Order contains all theagreements of the Parties with respect thereto and no course of dealing or usageof the trade shall be applicable unless expressly incorporated in this Order. Theterms and conditions contained in this Order may not be added to, modified,superseded or otherwise altered except by a written instrument signed by BuyerRepresentative and delivered by Buyer to Seller. Modifications of this Ordershall be handled pursuant to Article 10 “Changes and Equitable Adjustments.”Each shipment received from Seller shall be deemed to be exclusively upon theterms and conditions contained in this Order notwithstanding any terms andconditions that may be contained in any acknowledgment, invoice,correspondence or other documents of Seller, and notwithstanding Buyer’s actof accepting or paying for any shipment or similar act of Buyer.
