Clause:

Bidder's proposal will state the number of employees of Bidder, the place ofmanufacture of the goods (or performance of the services), whether Bidder is a large orsmall business pursuant to the rules of the Small Business Administration, and, ifmanufactured, performed, or subcontracted outside the U.S., the export license numberand whether Bidder is an affiliate of a U.S. firm.The Offeror is hereby notified that, under 15 U.S.C. 645(d), any person whomisrepresents a firm's business size or socioeconomic status as defined in FAR52.219-9 in order to obtain a contract to be awarded under the preference programsestablished pursuant to sections 8(a), 8(d), 9 or 15 of the Small Business Act or anyother provision of Federal law that specifically references section 8(d) for a definitionof program eligibility, shall:a. Be punished by imposition of a fine, imprisonment, or both;b. Be subject to administrative remedies, including suspension and debarment; andc. Be ineligible for participation in programs conducted under the authority of the Act.Socioeconomic status for Boeing subcontracts includes the list of concerns in FAR52.219-9 as well as women-owned small business concerns, Historically Black Collegeor University or Minority Institutions, Indian organizations or Indian-owned economicenterprises, rural area small business concerns, foreign business concerns, joint ventures,and/or a large minority business concerns or women-owned large business concerns.
